Starting a Prenuptial Agreement can feel daunting, but understanding the journey ahead can provide clarity and confidence. At our firm, we break down the process into clear, manageable stages, ensuring you are well-informed and prepared every step of the way. Here's a roadmap of what to expect:
We will review your intake questionnaire and begin drafting your prenuptial agreement based on your responses.
You should hear back from us in about 3-5 business days (Monday-Friday excluding holidays).
We will reach out to you if we need more information, if we need clarification on something you stated, if you asked us to reach out to you regarding questions you had, or if we see any other answers that we need to discuss with you.
Once we have discussed with you anything that needs to be discussed, we will complete the draft of the prenuptial agreement.
Stage 02: Completion and Sharing of Draft
We will notify you once the draft of your prenuptial agreement is completed. Once you have paid your invoice we will share the draft with you and with your spouse-to-be or your spouse-to-be's attorney (if your spouse has retained an attorney).
Once we share the draft, you should carefully review it. If you have any questions about the draft or if there are any changes or revisions you would like to make, please let us know. We will make the changes and upload the modified versions into the shared folder.
Your spouse-to-be or the attorney may also request modifications, which we will discuss with you and negotiate with them until all parties are satisfied.
Once you and your spouse-to-be are both satisfied with the draft, then we will schedule an appointment for you to come in and sign (or you can take them to a notary in your area if you are not local). Your spouse-to-be can come into our office to sign with you or sign at the attorney's office or before another notary.
Stage 03: Execution
Once you and your spouse-to-be are both satisfied with the draft of the prenuptial agreement, then we will schedule an appointment for you to come in and sign (or you can take them to a notary in your area if you are not local). The signing itself should only take about 20-30 minutes. This is a quick meeting because we are only signing the prenuptial agreement. You and your spouse-to-be have by this time reviewed it, approved it, and asked any questions you would like to ask.
This is not a meeting to go over the content of the prenuptial agreement or to make any changes - this is a meeting to sign it. So, if, at this stage, you still have questions, please let us know before coming in so that we can address everything ahead of time.
You will sign two counterpart originals, so that you can keep one original in your possession and your spouse-to-be can keep one original in his/her/their possession. We will retain only an electronic copy, which we will also share with you so that you can back it up as well.
You have completed your prenuptial agreement! Our post-signing letter will provide you with valuable information about your documents and how to store it. IT IS VERY IMPORTANT THAT THE ORIGINALS NOT BE LOST, DAMAGED, or ALTERED!
This prenuptial agreement can only be altered through the written consent of both parties. If you wish to make a change in the future, we recommend conferring with an attorney so that it is done properly and does not negate the entire agreement. That can be us or any other attorney of your choosing.
