I have been involved in guardianship cases for over 30 years and in most instances, they go through uncontested and without any glitches. Yet, they can still cost the client thousands of dollars in legal fees. Now there is a way to avoid that and save most of that money.

Smart Law Legal Platform approach

I am proud to introduce our new Smart Law Legal Platform that allows for what is known as “Limited Representation.” Under a “Limited Representation” arrangement, the client retains the lawyer for the limited purpose of doing a certain aspect of a matter and then the client assumes responsibility for the rest.

“Limited Representation” for a guardianship case

For example, in the context of a guardianship action, the agreement would be that the lawyer will prepare all the legal documents and forms necessary to file the guardianship in court, along with the assurance that the papers will be acceptable to the court. Once filed, the client would then represent themselves in court. And as I mentioned, in most cases, the matter will proceed uncontested so there is little risk that the client will run into any issues once they take over the case. But if they did run into a jam, that is not a problem since the lawyer can be re-engaged to help address whatever problem may have arisen.

This “Limited Representation” approach can be used if you are applying for guardianship for an older adult as well as a younger child turning 18. It can also be used if you are applying for full or limited guardianship.
