Being Prepared for the Unexpected: Disability and Incapacity

Posted by Anthony Serra | Aug 23, 2022 | 0 Comments

Every day, thousands of people across the country are suddenly forced to confront their own mortality when they become disabled or incapacitated.

When this happens, it can severely stress out the individuals who rely on you for financial support.  However, if you have a will and the proper accompanying estate planning documents in place such as a Durable Power of Attorney and Living Will, you will make things much easier for those who are caring for you since they will have both the authority and knowledge to act on your behalf.

A well-crafted estate plan is essential so that everyone knows what they need to do in order to help take care of you if something tragic happens leading to disability or incapacitation, or when health decompensates in old age.  Check out our past post The Three Things You Need In Your Estate Plan for a quick overview of what a well-crafted estate plan includes and entails.

Without an estate plan:

1) There is no guarantee that all of your property will eventually pass on through probate to the people you want to get your assets;

2) Your loved ones may end up incurring expensive legal fees trying to navigate an estate with no clear plan or direction in terms of your intent;

3) State law might decide who your beneficiaries will be and who should care for your minor children and manage their money;

4) An expensive guardianship case may need to be filed in order for a person to obtain the legal authority to act on your behalf.

I always like to say - TAKE control while you are IN control!

If any of these issues concern you, it is simple to address your concerns and document your wishes. We specialize in estate planning and elder law. We'll walk through every step together until each detail of your estate plan feels right and you feel confident that your future affairs are in order, no matter what happens.
